Limited Pollutant Removal
Self storage facilities rent out units to their tenants, but they have little oversite of how they are used. Sometimes facility owners find that their tenants have left pollutants in their units that, by law, must be disposed of in specific ways. This can be expensive and prevent you from leasing the surrounding units until the issue is corrected.
A standard self storage lease agreement should have wording that helps to prevent this type of loss by having a section in it that states that hazardous materials are not to be stored. Some leases go so far to list the types that are restricted such as: Gas, oil, flammable chemicals, explosives, fireworks, ammunition, corrosive, toxic, poisonous, or hazardous materials or waste.
Being a part of your states self storage association may give you access to a tenant lease agreement that has been reviewed by an attorney and has many of the necessary sections to advise a tenant on what they are allowed to store at your facility.

Customer Goods Legal Liability
As a self storage facility owner/operator one of the biggest issues you will face is damage to a tenants goods while in storage. A good lease can help to protect you for this risk, but having Customers Goods Legal Liability coverage will work hand in hand with your lease to protect you when a tenant claims damage to their goods.
We all know a self storage facility is not a warehouse. The facility never takes care, custody, or control of the tenants goods. However, there are some situations where you can be held liable for loss or damage. An example of this is when there is unrepaired roof damage at the facility and a tenants has water or mold damage to their goods. If the tenant(s) can prove that you knew about the damage and did not repair it, you can be held liability for their loss of goods.
Another example of when this coverage is used is when a tenant has some type of rodent or insect damage to their goods. If you do not have a schedule for pest control, they can claim you knew of the issue and did nothing to prevent the damage.
There is no end to the reasons a tenant may claim damages to their goods. Our policy can provide the protection you need by covering you for these types of losses. Our defense costs are outside of the policy limits, so the limit you choose is used for any damages you are held responsible for.
You can choose limits from $25,000 to $1,000,000 per occurrence on our policy. A good rule of thumb for picking a limit would be taking the limit you show on your lease as the maximum value of stored goods and multiple it by your largest building but discuss this further with your agent to make sure you are correctly covered.

Sales and Disposal Liability
One of the most common losses a Self Storage facility owner/operator is exposed to can be covered by sale and disposal legal liability coverage. Each state has its own laws and specific procedures on how to deal with delinquent tenants and what is allowed when removing or discarding their stored goods in your units. If any of the steps required are not followed to the letter of law, this leaves you, the facility owner, open to a possible loss. Our policy includes coverage for this exposure.
Some of the simplest human errors can cause losses of this type. If a unit number is transposed, then the incorrect unit can be auctioned, and that tenant can sue for their loss of goods. Another possible cause of loss could be that the notice of intent to sale a unit is not properly posted, or the delinquency letters are not mailed on time per the state requirements.
Another type of Sale and Disposal loss we see is when a tenant is active in the Military. There are special laws protecting Military Personnel regarding what procedures must be followed if they are deployed. Make sure your lease agreement has a question regarding any active or reserve Military status so you can avoid this possible pitfall.
The best way to avoid this type of loss to review your state lien laws and stay abreast of any possible changes to the law. A good way to do this would be to join your state self storage association or the national self storage association.
Sometimes even when you follow all the laws and requirements a tenant will still file a claim or hire legal counsel stating that you improperly sold or disposed of their goods, our policy will protect you! Our defense costs are outside the limits, so we will pay for your defense and the limit of coverage you choose will pay any damages.
Our policy includes coverage at $10,000, but this can be increased up to $1,000,000. This is an aggregate (policy term) limit so make sure you have a high enough limit to protect from possible multiple claims. A good rule of thumb is to look at how many sales of units you have in an average year but discuss this further with your self storage insurance agent to make sure you are correctly covered. Commercial General Liability Coverage
With tenants regularly on your premises, accidents can happen. Commercial General Liability coverage protects your business from bodily injury, personal injury, or possible property damage that may occur at your facility. Our policy is written on an occurrence form. That means the claims are covered when the event occurred, if during the term of the policy. Sometimes the insured is not aware of a liability claim until they receive a notice from the injured party, which could be well after the date of the claim. With our occurrence form, those types of losses would be covered even if that policy has expired.
Our policy provides a per occurrence limit of coverage as well as aggregate limits per location. This is helpful when an owner has more than one location.
This policy also provides coverage for Advertising Injury that may occur in the course of advertising your goods, products, or service.
Our policy also includes Medical Expenses coverage. This coverage will pay for some of the medical expenses incurred at the facility by the injured party (not the insured or their employees) regardless of fault. This coverage includes first aid at the time of the accident, necessary medical expenses, and transport via ambulance if necessary.

Employee Benefits Liability – This coverage will protect you in the event you become legally obligated to pay as a result of damages to an employee caused by a negligent act or omission in the administration of an Employee Benefit Program (group life, group health, pension plans, etc.)
Employment Practices Liability Coverage – This is a claims made endorsement to the General Liability that will protect you in the event you become legally obligated to pay damages due to a wrongful employment practice (discrimination, wrongful termination, etc)

Property Coverage
When you insure your facility, you want to make sure all your property is covered. Our policy provides coverage with a blanket limit. A blanket limit for your property coverage is beneficial as it does not limit individual structures to a specific value and the limit can be applied as needed in the event of a property loss. This limit not only covers the buildings at your facility, it also includes the following:
- Permanently installed fixtures and equipment (security cameras, lighting, keypads, etc.)
- Any business property/furniture you have in a resident manager apartment
- Property owned by you to maintain or service the facility. This includes any golf carts or lawn servicing equipment you may have.
- Glass coverage is included
- Fences and gates
- Unattached/Attached Signs
- Buildings under the course of construction are covered up to $1,000,000 on the insured property and include materials, equipment, supplies, and any temporary structures within 1000 ft of the premise.
Business Personal Property is covered and includes, but is not limited to, your office equipment, furniture, tv or monitor displays and any stock you may have in boxes, locks, packing materials.
Business Income coverage is included with 15 months of coverage Actual Loss Sustained – this can be increased to 18 or 24 months of coverage. This will protect you in the event of a covered cause of loss at your facility and will pay for your loss of business income during repairs to the damage property.
Additional coverages included in our property policy are as follows:
- Employee Dishonesty coverage is included at $15,000 – this can be increased
- Employee Property coverage of $10,000 is included
- Valuable Papers and Records coverage is included at $25,000 – this can be increased
- Accounts Receivable coverage is included at $25,000 – this can be increased
- Mini Computer Coverage is included at $20,000 – this can be increased
- Pollutant Cleanup and Removal is included at $25,000 – this can be increased
